These Terms and Conditions ("Terms") govern your use of our website and the real estate services provided by Florida Flex Realty, a licensed real estate brokerage in the State of Florida. By accessing our site or purchasing a service, you agree to be bound by these Terms.
1. Scope of Services
CloseWithFlex (a division of Florida Flex Realty) provides limited-service real estate marketing and transaction coordination.

ListWithFlex ($99 Listing): This is a "Limited Service" entry into the local Florida MLS. We syndicate your property data to third-party sites (Zillow, Realtor.com, etc.).

CloseWithFlex Audit/FlexShield: This service includes a strategic review of contracts, disclosure compliance, and deadline tracking. It does not constitute full-service legal representation or a guarantee of a specific closing outcome.
2. Seller Responsibilities
To maintain our flat-fee pricing model, the Seller agrees to the following:

Accuracy: Seller is solely responsible for the accuracy of all property data, square footage, and disclosures provided to the MLS.

Media: Seller must provide their own professional-quality photography.

Access: Seller is responsible for managing all property showings, open houses, and providing buyer access (lockboxes).

Compliance: Seller must comply with all Florida Fair Housing laws and property disclosure requirements.
3. Brokerage Relationship & "Limited Service"
Per Florida Statutes, Florida Flex Realty acts as a Transaction Broker unless otherwise disclosed in writing.

You acknowledge that for the $99 MLS listing, Florida Flex Realty is not your exclusive representative for negotiations or property showings.

Our role is to provide the platform (MLS) and, if purchased, a strategic audit of your transaction documents.
4. Fees and Refunds

Flat Fee: The $99 listing fee is a non-refundable administrative fee for the entry and maintenance of the MLS data.

Service Term: Listings are active for an initial term of 6 months. Extensions may be granted at the Broker's discretion.

No Hidden Commissions: We do not collect a percentage-based listing commission. Any commission offered to a Buyer’s Agent is determined solely by the Seller and disclosed on the MLS.
5. Phone Number & Lead Policy
Per MLS regulations, the Brokerage phone number must be the primary contact on public real estate portals. CloseWithFlex utilizes an automated routing system (Dialpad) to forward all inquiries directly to the Seller. Florida Flex Realty is not responsible for missed calls or technical failures of third-party routing services.
6. Limitation of Liability
Florida Flex Realty and CloseWithFlex provide services on an "as-is" basis. We are not liable for:

Errors in data syndication on third-party websites (Zillow, etc.).

Actions or omissions of Buyers or Buyer’s Agents.

Property damage occurring during Seller-managed showings.
7. Termination
The Seller may cancel their listing at any time. Florida Flex Realty reserves the right to terminate any listing that violates MLS rules, Florida law, or contains fraudulent information.
8. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of the county where the Brokerage is headquartered.
